British court rules "Da Vinci Code" is not a copy...
By DANICA KIRKA, Associated Press WriterLONDON - Britain's Court of Appeal rejected a lawsuit Wednesday from two authors who claimed novelist Dan Brown stole their ideas for his blockbuster novel "The Da Vinci Code."
Both books deal with the theory that Jesus married Mary Magdalene and had a child, and that the bloodline continues.
One of the judges said copyright protects an author's labor in researching and writing a book, but does not extend to facts, theories, and themes.
Brown was not a defendant in the case. He testified last year that he studied the plaintiffs' book when writing his best-seller but did not copy from it.
The authors now face legal bills of about $6 million.
Baigent and Leigh "expended a vast amount of skill and labor" on their book, their lawyers said. "That skill and labor is protectable."
Brown testified for several days during the High Court hearing last year.
The claimants' lawyer, Jonathan Rayner James, said that although the suit had been against the publisher rather than the author, Brown was really the one on trial.
During a hearing earlier this year, Rayner James said issues remained about the role of Brown's wife, Blythe, who did much of the research. She did not testify at the High Court hearing. Brown said he wanted to protect his wife from publicity.
In April, Justice Peter Smith ruled that Random House had not breached the copyright. Smith said the claim was based on a "selective number of facts and ideas artificially taken out of (the book) for the purpose of the litigation."
"The Da Vinci Code" has sold more than 40 million copies since its release in March 2003. A film version starring Tom Hanks was released last year.
Lord Justice Bernard Rix said Brown had not disguised his use of the work of Baigent and Leigh.
The character of Leigh Teabing is an anagram of Leigh and Baigent, Rix noted, and at one point Teabing refers to "The Holy Blood and the Holy Grail" as "perhaps the best-known tome" on the subject.
"That is not the mark of an author who thought that he was making illegitimate use of the fruits of someone else's literary labors, but of one who intended to acknowledge a debt of ideas, which he has gone on to express in his own way and for his own purposes," Rix wrote in his opinion.
Me in a nutshell
The Meaning of Insight...
Insight is not an act of remembrance, the continuation of memory. Insight is like a flash of light. You see with absolute clarity, all the complications, the consequences, the intricacies. Then this very insight is action, complete. In that there are no regrets, no looking back, no sense of being weighed down, no discrimination. This is pure, clear insight - perception without any shadow of doubt. Most of us begin with certainty and as we grow older the certainty changes to uncertainty and we die with uncertainty. But if one begins with uncertainty, doubting, questioning, asking demanding, with real doubt about man's behaviour, about all the religious rituals and their images and their symbols, then out of that doubt comes the clarity of certainty.

American Cannibal: The Road to Reality (NR); Limited
Two struggling, desperate-for-success TV writers partner with a porn promoter to create a shocking reality show involving cannibalism and a desert island. Struggling sitcom writers Dave Roberts and Gil S. Ripley are urged by their manager to focus on reality programming. After being spurned by one network after another, they start to pitch increasingly outrageous concepts, finally hooking up with Kevin "K.B." Blatt, the promoter behind the Paris Hilton sex tape. Blatt enthusiastically bankrolls the Darwinian American Cannibal, a show that originated as an absurd example of how far reality TV could be pushed. Contestants on this show are starved on a desert island for days and then scared with hints of cannibalism. The drama behind the actual documentary stems from its exploration of the two writers' moral evolution: while Roberts turns giddy at the prospect of a hit show, Ripley grows increasingly disillusioned. When one of the contestants becomes critically injured, Roberts beats himself up on camera, and both he and Ripley bail on the project. The inescapable irony is that Roberts and Ripley have now inadvertently become stars of their own reality show.
